Fit Beer is a fitness-calorie comparison tool. It does not sell alcohol, recommend drinking, provide medical advice, or promise that calorie estimates are exact.

01 Acceptance

These Terms of Service are an agreement between you and the developer of Fit Beer (“Fit Beer,” “we,” or “us”). By downloading or using the app, you agree to these terms. If you do not agree, do not use the app.

02 What Fit Beer does

Fit Beer uses active-calorie and workout information you allow it to access through Apple Health, together with a drink-calorie target, to show calorie equivalents. The Apple Watch app can also record workouts you start in Fit Beer and save them to Apple Health with your permission.

03 Not health advice

Fit Beer is for general information and entertainment. It is not medical, health, nutrition, exercise, or alcohol-consumption advice. It is not an emergency service or a substitute for professional advice, diagnosis, or treatment. Stop exercising and seek appropriate help if you feel unwell or unsafe.

04 Estimates and accuracy

Workout energy, active calories, serving sizes, and drink calories are estimates and can vary by person, device, product, and data source. Fit Beer does not guarantee that any value, equivalent, total, notification, or workout record is complete or exact. Do not make health, safety, or drinking decisions based only on the app.

05 Alcohol and safety

Fit Beer does not sell, supply, or encourage alcohol consumption. A calorie equivalent is not a recommendation, reward, allowance, or statement that drinking is safe. If you choose to drink, do so responsibly, follow the law where you are, and do not drink unless you are of legal drinking age.

06 Apple Health permissions

You control whether Fit Beer can read from or write to Apple Health. Some features will not work without the relevant permission. You are responsible for reviewing the permissions you grant and the information stored in Apple Health. Our handling of information is explained in the Privacy Policy.

07 License and fair use

We give you a limited, personal, non-exclusive, non-transferable, revocable license to use Fit Beer for your own lawful, noncommercial purposes. You may not copy, resell, distribute, reverse engineer, interfere with, misuse, or attempt to gain unauthorized access to the app, except where the law expressly allows it.

08 Apple services

Fit Beer relies on Apple services, including the App Store, Apple Health, iPhone, and Apple Watch. Your download and use may also be subject to Apple’s Media Services Terms and Standard End User License Agreement. If Apple’s terms conflict with these terms, Apple’s terms control to the extent required. Apple’s services may change or become unavailable, which can affect Fit Beer.

09 Availability and changes

We may update, change, suspend, or stop parts of Fit Beer when reasonably necessary, including for maintenance, security, legal, or product reasons. We do not promise that the app will always be available, uninterrupted, or compatible with every device or operating-system version.

10 Disclaimers

To the fullest extent permitted by law, Fit Beer is provided “as is” and “as available,” without warranties of accuracy, reliability, fitness for a particular purpose, merchantability, or non-infringement. Some laws do not allow certain warranty exclusions, so those exclusions may not apply to you.

11 Limitation of liability

To the fullest extent permitted by law, Fit Beer and its developer will not be liable for indirect, incidental, special, consequential, or punitive damages, or for losses arising from reliance on calorie estimates, exercise, alcohol consumption, lost data, service interruptions, or use of the app. Nothing in these terms limits rights or liability that cannot legally be limited.

12 Ending use

You may stop using Fit Beer at any time. Your license to use the app ends if you materially violate these terms. Sections that are meant to remain in effect after use ends, including disclaimers and limits of liability, will continue to apply.

13 Changes to these terms

We may update these terms as Fit Beer changes. The effective date above will change when we do. If a change is material, we will provide notice in the app or through another appropriate method when required. Continuing to use Fit Beer after updated terms take effect means you accept them.
